President Uhuru loses case to student who insulted him

President Uhuru Kenyatta on Friday, July 3, 2015 lost a long court battle with a 25-year-old university student who had been jailed for insulting him on social media.

Mr Allan Wadi, a fourth year student at Moi University, in January this year admitted to insulting the president through Facebook and was jailed for two years for the offence.

However, upon appealing the matter, he has been set free six months into his jail term after his lawyer argued that he was not mentally fit when pleading guilty to the charge six months ago, reports Tuko.

“I am insane and would want to meet President Uhuru and apologise in person,” the fourth year student told the court in January, which was apparently then understood to mean he was actually pleading guilty to the charge.

Justice Luka Kimaru, on hearing the appeal from the student, determined that indeed his admission of guilty was not in order and thus ordered his release from jail.

Mr Wadi’s lawyer argued that the court failed to order a psychiatric analysis on him despite him clearly saying he was insane. The 25-year-old had also been convicted of hate speech, after saying members of the Kikuyu ethnic group should be confined to certain parts of the country.
