Nakumatt, East Africa’s biggest supermarket, has been sued by the Consumers Federation of Kenya (COFEK) for mismatching prices of commodities. The retail chain has been taken to court following discrepancies in price labels and till payments.

The pricing concern went viral on social media a fortnight ago, with many Kenyans stating that they had been charged higher prices than the ones labelled on the shelves. Stephen Mutoro, Cofek Secretary General, told Tuko.co.ke that the suit against Nakumatt is meant to be a warning to other stores “because the practice of misleading consumers is apparently on the increase.”

Mr Mutoro said COFEK lawyers filed the case on Monday June 8, at the High Court. A part of the evidence they are relying on are complaints that Kenyans posted on social media complete with receipts issued by the store indicating price differences as one above. Responding to the claims on May 18, Nakumatt management said it had launched investigations after the barrage of comments regarding their pricing.

“Our preliminary investigations and internal audit confirm that the discrepancies are isolated and inadvertent. Immediate corrective measures have also been instituted to ensure and guarantee our system integrity particularly on this pricing concerns,” Mr Atul Shah, managing director, said in a statement.
