The director of Public Prosecutions Keriako Tobiko has ordered for the prosecution of Godfrey Mutahi Ngunyi, the renowned political commentator and consultant over his remarks he made on his twitter account which amount to hate speeh.
Mutahi Ngunyi, who had branded himself as a level-headed and independent analyst, found himself in the eye of a storm in August after he tweeted information profiling the Luo community as ‘poverty stricken.’
The prosecution will dent Ngunyi’s brand as a political commentator, analyst and consultant. Mr Ngunyi has been a respected opinion shaper on the political scene but his star appears to be dimming and the ethnic profiling case threatens to engulf him.
The DPP says there is sufficient evidence to charge Mr Ngunyi with the offence of ethnic contempt. “On perusal of the file, the DPP is satisfied that there is sufficient evidence to charge the above-named person with the offence of Ethnic Contempt contrary to section 62(1) of the NCIC act,” the statement read.
However, Mr Ngunyi had earlier, on September 9th apologised to the community he allegedly targeted through his tweets. The political consultant offered a goat as a sign of goodwill and to appease the community leadership, presented to Law Society of Kenya (LSK) chief executive Apollo Mboya, who had lodged a complaint to the National Cohesion and Integration Commission (NCIC).
Mr Mboya, on this occasion acted as an emissary to the Luo Council of Elders and Cord leader Raila Odinga. “In relation to messages he allegedly posted on his twitter account targeting Raila Amolo Odinga and the Luo community, the DPP has therefore directed that he be charged accordingly,” the statement concludes.
