Court orders teachers to end strike

The four weeks teachers’ strike has been suspended and teachers ordered to resume work immediately. The Employment and Labour Relations Court in  Nairobi said the striking teachers to go back to class.

Judge Nelson Abuodha also asked the government and the teachers unions to form a conciliatory committee and resolve the pay dispute that has seen learning in public schools paralysed. “Teachers should suspend the strike and resume work immediately,” he ordered.

He further asked Teachers Service Commission not to victimise teachers over the strike and ordered for the full payment of their salaries for September without any penalties even though they have not worked for it. “No teacher should be victimised to have participated in the strike,” the judge said. “Salaries should be paid in full without any deductions of time wasted during strike period.”

While ruling on the matter, the Judge said the parties are at liberty to declare a trade dispute should they fail to find a solution within the given period. The Court also declared the strike legal and protected by the law.

Kenya National Union of Teachers is yet to respond to the ruling.
