A Busia Court today sentenced three young men to fifteen years imprisonment after they were found guilty of gang raping and causing grievous harm to a then sixteen year old girl in Busia County in June 2013.
In her judgment, the Senior Principal Magistrate Margaret Wambani observed that the Prosecution had proved beyond reasonable doubt that the trio had committed the said offences and sentenced them to fifteen and seven years respectively. The sentences will run concurrently.
The victim, referred to as “Liz” to protect her identity, was attacked and repeatedly raped when she was returning home from her grandfather’s funeral in a village in Busia in western Kenya. The accused then dumped her in a disused pit latrine from where she was rescued by neighbours who heard her cries and took her to hospital.
When the rape was first reported to Administration Police at Tingolo in Busia County, the three suspects were ordered by the police to cut grass as punishment leading to protests from the public and human rights activists.
Following the public outcry, the Director of Public Prosecutions directed for further investigations into the matter which led to the registration of the matter in court. The trio were then rearrested and arraigned in court.
