Kidero silences Khalwale on Mumias Sugar

Nairobi Governor has won the first round in the defamation case against Boni Khalwale after the court stopped the Kakamega senator from making statements linking him to the financial troubles at Mumias Sugar Company.

Dr Kidero made good his threat to sue Dr Khalwale for refusing to apologise over his allegations that he presided over the looting of the sugar miller during his tenure as managing director.

Justice Joseph Sergon yesterday ruled in Nairobi that pending the hearing and determination of the suit, Dr Khalwale or anyone associated with him, should not link Dr Kidero to the scandal.

“Pending hearing and determination of the suit, a temporary order is hereby issued restraining Dr Khalwale, or any person acting through him, from further making defamatory statements against Dr Kidero in relation to the management of Mumias Sugar Company,” ruled Mr Sergon.


The Nairobi governor, through senior counsel Tom Ojienda, argued that the statement made by Dr Khalwale at a function last week in Mumias was defamatory and meant to portray Dr Kidero as a thief.

Prof Ojienda submitted that despite writing a demand letter to him to withdraw the statement, Dr Khalwale held a press conference where he repeated the defamatory words against Mr Kidero. “Dr Khalwale continues to engage in bad publicity, character assassination and incitement of public spite against the governor,’’ said Mr Ojienda.
