Company MD charged with defaulting on Sh533m tax payment

Kenya Revenue Authority (KRA) has charged a company director for defaulting on payment of taxes amounting to Ksh 523 million.

Brian Nasiohe Waluchio, the managing director of Oxygen8 East Africa, appeared before the Makadara Chief Magistrate’s Court, where he was charged with three counts of defaulting on obligations imposed under Tax Law and Tax Procedure Act.

In the first count, Nasiohe together with Oxygen8 East Africa Ltd, with others not before court was accused of defaulting on an obligation to pay withholding taxes amounting to Ksh 522, 518, 690 to the Commissioner, Domestic Taxes as required by law, KRA Commissioner, Investigations and Enforcement David Yego said in a statement.

The offence was committed between 20th January 2016 and 20th October 2018 within Nairobi County. Oxygen8 East Africa Ltd deals in products, goods, merchandise, services and activities related to SMS VAS and Mobile Financial Services.

On the second and third counts, Nasiohe is charged with deliberately defaulting on obligation to submit income tax returns for the year 2015 and for the year 2017 respectively.

The accused denied all the charges and was released on Ksh 1 million cash bail. The case was set for hearing on 16th and 17th February 2018.
