The Supreme Court on Friday dismissed a petition challenging the election of Alfred Mutua as Machakos Governor filed by his political nemesis Wavinya Ndeti.

Kenya’s apex court ruled that Mutua vas validly elected after the governor through his lawyer Kioko Kilukumi faulted the Court of Appeal’s decision to nullify his election on grounds that it was marred with irregularities and illegalities.

Ms. Ndeti first challenged Mutua’s win in the 2017 polls at the High Court but her case was dismissed by Justice Aggrey Muchelule on February 9 who ruled that the former Kathiani MP did not prove her claims.

Unsatisfied with the High Court’s ruling, Wavinya moved to the Court of Appeal which nullified Mutua’s win on grounds that the returning officer used the wrong form while declaring the results.

“It is hereby directed that the third respondent was not validly declared as the Governor of Machakos County. IEBC is hereby directed to organise and conduct a fresh election for the position of the Governor of Machakos County in conformity with the constitution, the Elections Act and the relevant regulations,” The Appelate judges ruled in a statement read on their behalf by Justice William Ouko.

The Supreme Court ruling came as a huge relief for Mutua who termed it as a Launchpad for his Presidential bid.
