Lawyer Faith Odhiambo has questioned why police fired tear gas to disperse tiny traders who were peacefully protesting in Nairobi’s Central Business District against new tax measures and increase in import duty from Sh2.5 million to Sh3.2 million.
The former president of Law Society of Kenya, who also doubles as a partner at Ombok and Owuor law firm says it is unfortunate that when traders attempt to raise legitimate concerns about policies that affect their businesses and families, they are met with tear gas and force.
“Such a response sends the troubling message that their grievances are neither being taken seriously nor considered. Article 37 of the Constitution is not a ceremonial promise; it protects the right of citizens to assemble, demonstrate, picket and present petitions peacefully,” she says.
She adds that traders are not enemies of the government but citizens confronting policies that directly affect their businesses and families, noting that their grievances deserve engagement, accountability and humane treatment.
“A constitutional democracy must make room for dissent, especially from those whose voices are too often ignored. We cannot celebrate the Constitution in speeches and violate its spirit in practice,” she explains.
