Former President late Mwai Kibaki’s daughter Judith Kibaki is set to auction controversial businessman Kevin Obia over rent arrears amounting to Ksh3.1 million.

Already, Judith has engaged Wiskam Auctioneers who have set the auction date for Wednesday, May 24, 2023.

Initially, Obia had obtained an order barring Judith from auctioning him over the arrears, before the order was lifted on Friday by Milimani principal magistrate B.M. Cheloti.

Among the items set for auction include two double-door refrigerators, an electric burner cooker, and eight pieces of dining chairs, a five-seater sofa set, a vacuum cleaner, beds and beddings, flower pots among others.

Obia, according to court submissions, had defaulted on rent payments of Ksh2.5 million as of February.

Obia had leased the premises for a period of two years on a monthly rent of Ksh350,000.

“Since occupying the suit premises, the applicant has consistently defaulted on payment of the monthly rent,” Judith said.

As of January 31, he had rent arrears of Ksh2.78 million and paid Ksh996,000 on February 28 after he was served with a demand letter.

“That it is unconscionable for me to be restrained from interfering with the applicant’s tenancy yet he is defaulting tenant. Such an order defies all legal safeguards of a property owner,” Judith said.

In 2021, Obia was sentenced to one year in jail for defrauding an Australian national of Ksh13.7 million in a fake gold scam.
