Two splinter groups of Muslims are involved in a vicious court tussle over property ownership worth over Ksh 1 billion within Eldoret town and its environs.
The disputed properties between the North Rift Youth Daawa group and the Muslim Association are spread within the town’s central business district and Elgon View estate.
The chairman of North Rift Youth Daawa group Suleiman Ewaton and a section of Muslims have moved to the High Court in Eldoret beseeching the court to compel the County Director of Criminal Investigations to carry out investigations into the alleged misuse of the association’s properties including donor funds.
In a sworn affidavit before court, Ewaton argues that since 1990 the respondents have not handed over the association’s properties to the new committee members.
They want the respondents to avail rent records for one of the commercial buildings which they claim has accrued an income of Ksh 57 million over an eight year period.
They also asked the court to compel the respondent to produce all Muslim youth projects in North Rift region they purport to be undertaking through the Jamia Mosque and donor funds.
They further demanded that the respondents present the title deed of a mosque in Mwanzo estate that was fundraised for by Muslims in Eldoret Jamia Mosque where a total of Ksh 3 million was realised.
They alleged that members of the Muslim association have been disposing properties of the association without the consent or knowledge of members.
The multi-billion shillings properties include several bank accounts, a prime six-acre piece of land in the affluent Elgon View estate, a commercial building in the CBD, several primary and secondary schools and several rental plots in Pioneer estate.
They want investigations over the division of the mosque plot block 6/110 which he claims was sub-divided illegally into four plots.
Other properties in dispute include Eldoret municipality Block 5/205, Block 5/749, Block 6/100, Block 6/104, Block 6/110, Block 6/113, Block 6/114, Block 6/117 and Block6/98.
They are also seeking court orders to have the respondents vacate office and hand over the Muslim Association records to the Muslim steering committee.
