Migori Governor Okoth Obado was on October 24 released on a cash bail of Ksh 5 m***ion bringing his one month stay in remand to an end.
High Court Judge Justice Jessie Lessit w** released Governor Obado on tough conditions outlined that the county chief w*** also be required to provide two sureties of Ksh5 m***ion and deposit his travel do***ents including his Kenyan, East African and diplomatic p***ports.
“The court w*** be at liberty to cancel his bail and bond and to remand him in custody if any of the conditions I have spelt out are breached,” ruled Justice Lessit.
Justice Lessit outlined that Obado’s bail w*** be cancelled if;
• He causes any adjournments to the case.
• The Migori Governor fails to report to the court’s deputy registrar once a month.
• If he tampers or intimidates witnesses as per witness statements.
• If he communicates with parents, siblings and close friends of the now deceased Ms. Otieno.
• If he is at any given time within 20 kilometres of **ma Bay County’s boundaries from any direction where the ****** of Sharon Otieno which he has been charged with, took place.
Governor Obado’s aides Micheal Oyamo and Caper Obiero were den*** bail as the judge ruled that they pose a significant threat to witnesses.
“There are compelling reasons as not to grant the second and third accused bail at this stage. I find releasing them may send fear, anxiety to potential witnesses and therefore lead to intimidation which may adversely affect the case,” ruled Justice Lessit.
Justice Lessit also set the pre-trial hearing for February 14, 2019.
