KFS appeals ruling barring it from constructing new ferries

The Kenya Ferry Services has appealed the High Court order stopping it from continuing with the construction of one of the two ferries that were being constructed in Turkey.

Through lawyer Nani Mungai of MMC Africa Law, Kenya Ferry argued that the judge was wrong in issuing the injunction because there were no safety concerns raised about MV Safari and because there was great public interest in allowing the construction to continue so as to ease the traffic at the Likoni Channel.

The appeal is against an order of injunction issued by High Court Judge Eric Ogolla on August 1, 2017. The judge had stopped Kenya Ferry Services Limited from continuing with the construction of one of the two ferries that were being constructed in Turkey.

The first ferry (MV Jambo) had been constructed, commissioned and is currently serving the Likoni Channel. The second ferry (MV Safari) is the one whose construction has been stopped.

Appellate Judges Alnashir Visram, Wanjiru Karanja and Martha Koome will deliver their ruling on 26th April 2018.
