The PrideInn Hotels has moved to Court of Appeal to challenge a ruling by High Court seeking to wind up its business for failure to pay Ksh 69.3 million.

Tropicana Hotels, which filed the petition, says PrideInn has been unable to pay the debt that was due in April 2012.

“We confirm the ruling made by the High Court, however strongly contest the ruling and we have moved to Court of Appeal to challenge the finding by the learned Judge,” says Hasnain Noorani, Managing Director, PrideInn.

“We highly dispute the debt in question because of fraud, misrepresentation and coercion. We however remain fully able and willing to pay should the Court of Appeal rule otherwise,” he said.

He claims in the statement that the official receiver has not taken control of the facilities as directed by the court. The hearing of the case in Court of Appeal is expected tomorrow, October 4.
