Judge Odunga fines Matiang’i, Boinnet Sh200,000

The High Court has fined Interior CS Fred Matiang’i, IG Joseph Boinnet Sh200,000 each for contempt of court.

Justice George Odunga, in a ruling on Thursday, also ordered Immigration PS Gordon Kihalangwa to pay the same amount.

“The money will be deducted from their salaries. The registrar should make sure this happens,” he said at the court.

Odunga said since the respondents are in charge of security, it will be difficult for their juniors to execute warrants of arrest.

“None of their juniors will hold them in custody. This court cannot make orders in vain.. I must make sure the laws are abided by,” he said.

The judge further held that the orders must be carried out effectively and efficiently.

“I am surprised that the respondents would avoid coming to court. It is clear that their status has displayed an arrogance of unimaginable magnitude,” he said.

Odunga said the manner that the three have conducted themselves does not inspire confidence at all.

“I am not prepared to believe that they are not aware of these orders. If they have knowledge, then they should not occupy the positions they occupy,” the judge said.

Earlier, of Miguna Miguna’s lawyers asked the government’s counsel to be found in contempt and barred from practising in superior courts.

Senior Counsel John Khaminwa held that they (government counsel) failed to discharge their duties so they cannot go Scot free.
