Prime CS Mudavadi Announces New Sub-Counties in Kenya for Better Governance

As the acting Minister of the Ministry of Interior and National Administration since Kithure Kindiki was promoted to Deputy President after Rigathi Gachagua’s impeachment, Prime Cabinet Secretary Musalia Mudavadi has announced the establishment of new sub-counties in the exercise of the broad authority given to Interior Cabinet Secretaries by law.

That is the National Government Coordination Act, 2013, Section 14(1), which states that the Cabinet Secretary of the Ministry of Interior may, with the approval of the President and by a notice in the Gazette, establish new sub-counties, otherwise referred to as the national government service delivery coordination units in respect to the Act.

The coordination units, in this case, are crucial for the purposes of the provision and delivery of sufficient, affordable, and quality basic services such as water, sanitation, waste management, housing and security, all of which are core government functions.

Periodic reviews of boundaries are normal and are mainly conducted due to population changes and the need for fair representation. These new coordination units will now have new deputy commissioners, who serve as administrative officers of sub-counties appointed by the national government on the recommendation of the Public Service Commission (PSC).

Prime CS Mudavadi indicated that the government had created 31 new sub-counties. It subsequently led to a rise of 59 divisions, 170 locations, and 322 sub-locations, effectively addressing service delivery and equal representation.

In Kenya, the sub-counties are equivalent to the constituencies within the county, as stipulated in Section 48(1b) of the County Governments Act. In this context, it is still not clear whether the Independent Electoral and Boundaries Commission (IEBC) will approve the new coordination units as constituencies for the purposes of elections.
