Royal Media Services has withdrawn its case that challenged the recent TV shutdown by the government.

Lawyer Gibson Kamau Kuria told Justice Chacha Mwita that the company is no longer interested in pursuing the case, which also sought compensations for losses incurred during the period its TVs were off air.

However, a similar petition filed by activist Okiya Omtatah will proceed as he said he still wants a full hearing.

KTN, NTV, Citizen and Inooro TV were switched off over Nasa leader Raila Odinga’s ‘swearing-in’ as the People’s President on January 30.

KTN and NTV were reopened on February 6 and Citizen and Inooro two days later after the government bowed to local and international pressure.

The first two were turned on after Omtatah filed contempt proceedings against Interior CS Fred Matiang’i, Joe Mucheru and the Communications Authority board for failure to restore transmission.

In his application, Omtatah said even after serving the CSs with a copy of the orders through the press, they blatantly disobeyed the court’s directive so they should be punished.

Matiang’i claimed Nasa had planned a massacre and that some media houses were aware.
