James Mugo, the bogus doctor accused of sexually assaulting sedated patients, was today detained for 10 days for failing to attend trial and mocking witnesses on his Facebook page. Commonly known as Mugo wa Wairimu, the fake medical practitioner caught on tape raping a sedated patient in his clinic will spend over a week in police custody after Nairobi Chief Magistrate Daniel Ogembo ordered him to be  detained until September 2nd when he will rule on his bail.

In his defense Mugo claimed that he was unwell on the said date and presented hospital documents before the court to prove he was admitted. The prosecution, however, objected to the medical documents since they indicated he was admitted at Milan Clinic, a maternity facility.

The court had earlier issued a warrant of arrest against him, but was subsequently lifted by Senior Principal Magistrate Joyce Gandani who directed Mugo to appear before trial magistrates Daniel Ogembo to clarify why he failed to turn up in court ion July 11

The prosecution claimed that the accused has been making numerous applications thus deliberately delaying the trial, and applied for the accused to attend trial while in custody. He was charged in October 2015 with 12 counts of rape, sedating his female patients and operating clinic without a license.

The prosecution also accused the controversial doctor of interfering with witnesses through his Facebook page. Mugo wa Wairimu was released on a bond of Ksh5 million with an alternative cash bail of Ksh1 million on October 5, 2015. He failed to deposit the cash bail and was detained at Industrial Area Prison.

Chief Magistrate Daniel Ogembo adjourned his case until the defense collects sufficient witness statements.
