Win for MCAs in fight for fat pay

The Salary Remuneration Commission (SRC) has been restrained from effecting salary pay cut for Members of County Assemblies (MCAs) pending conclusion of their case contesting new perks for state officers. Judge Chacha Mwita issued the temporary order following an urgent suit.

In their suit papers, the MCAs want a gazette notice affecting the salary pay cut quashed. It is their argument that the new remuneration and benefits for State Officers should not be implemented on grounds that they are unreasonable and SRC ignored relevant considerations before setting them.

They contend that the gazette notice is discriminatory, malicious, and arbitrary and goes against their legitimate expectations. The MCAs claim the salary capping has negatively affected the effective functioning of the 47 County Assemblies and County Governments in performing necessary functions to realise devolution.

According to MCA’s, SRC failed to conduct a comprehensive job evaluation and resorted to making a determination that is in excess to its jurisdiction. They say since publication of the disputed gazette notice, they have engaged SRC to have it reversed without success.

They argue that replacing the mileage allowance with a fixed monthly transport allowance payable through payroll is not workable.

Among the things MCA’s are challenging is the decision by SRC to do away with their sitting allowances, car grants and reduced allowances, which included mileage allowances.
