DPP opposes Kuria’s bid to bar media from case

The Director of Public Prosecutions has opposed the application by Gatundu South MP Moses Kuria to bar the media from covering proceedings of his hate speech case.

Mr Kuria’s lawyer, Danson Mungatana, made a preliminary objection seeking to bar the media from before Milimani Principal Magistrate Teresiah Nyangena claiming they would prejudice his case.

The DPP, through Senior Assistant Director of Public Prosecution, Dr Leonard Maingi, opposed the application as having no basis for the in-camera proceedings. He said Article 50 (2)(d) enshrines the right to public trials, noting that the  utterances were made at a public rally and therefore could not be adjudicated behind closed doors.

The DPP had moved to court under certificate of urgency last week to cancel the bail, which had been earlier granted to the MP following fresh hate speech allegations against him.
The court will make the ruling on the application to exclude the media on July Monday 20, 2015.
