Former governor’s wife sues for defamation

Edith Malombe, the wife to former Kitui Governor Julius Malombe, has instituted a defamation suit against Kitui National Youth Council (NYC).

Mrs Malombe, in the suit filed at the High Court in Kitui, has listed NYC county chairman Aggrey Nzomo and delegates Benedict Kilonzo and Edward Kituva as first, second and third defendants respectively. She alleges that the youth leaders posted derogatory comments and articles on social media in the count-down to the August 8, 2017 General Election.

The former governor’s wife, who is represented by lawyer Apollo Muinde, in her affidavit, argues that the said slur occasioned hostility towards her and her husband among the residents of Kitui and made it difficult for the then governor to discharge his official duties as expected.

Dr Malombe, who lost the gubernatorial race to former Water minister Charity Ngilu, has petitioned against her election.

Though the defendants have not filed a replying affidavit , they have, through their lawyer Mutavi Maseki, asked Kitui Resident Judge Linnet Mutende to compel the plaintiff to produce concrete evidence linking them to the said defamation.

The judge ordered that the plaintiff responds to the petition within the next 21 days and directed that the case be mentioned on February 20, 2018.
